Expulsions

Those who have been subject of an expulsion decree, pursuant to Article 13 of Consolidated Law no. 286 of 1998, are in need of a special authorization issued by the Ministry of the Interior in order to regain access to Italy. The Italian Embassy in Pristina is responsible exclusively for forwarding the request for revocation of the expulsion order to the above-mentioned authorities, and for notifying the interested party of the relevant decisions taken in this regard. The request may be submitted in cases of deadline expirations, family reunifications and voluntary returns.

The request should be personally signed by the applicant at the counter upon submission.

If an expulsion order has been received in other countries within the Schengen zone, in order to obtain information on the request for revocation of the expulsion it will be necessary to contact the competent authorities of the issuing country.

If an expulsion order has been issued by judicial authorities, in order to obtain information on it it will be necessary to contact the above-mentioned competent authorities directly or through a lawyer, not through the Consular Chancellery of the Italian Embassy.

Below it is possible to find the needed documentation in order to request special authorization to return to Italian territory or the revocation of the ban on re-entry into Italy based on Article 13, Clause 13 of Law 286/1998. This documentation should be presented in person, after scheduling an appointment through the Prenotami portal.

 DEADLINE EXPIRATION

  • Request for special authorisation to return to Italy addressed to the Italian Ministry of the Interior;
  • Birth certificate with Apostille, issued no earlier than three months from the submission of the application. N.B: In case of a change of personal data, it will also be necessary to present the “Certificate from Archive” with Apostille and its translation into Italian;
  • Passport and 2 photocopies of the pages containing personal data, as well as entry and exit stamps;
  • Copy of the expulsion decree* (if lacking the decree, read the note at the bottom of the page);
  • Appropriate documentation proving the exact date of exit from Italian territory and the absence from the territory of the Schengen states for the duration foreseen by the expulsion decree.

  FAMILY REUNION

  • Request for special authorisation to return to Italy addressed to the Italian Ministry of the Interior;
  • Birth certificate with Apostille, issued no earlier than three months from the submission of the application. N.B: In case of a change of personal data, it will also be necessary to present the “Certificate from Archive” with Apostille and its translation into Italian;
  • Passport and 2 photocopies of the pages containing personal data, as well as entry and exit stamps;
  • Copy of the expulsion decree* (if lacking the decree, read the note at the bottom of the page);
  • Marriage/civil union certificate issued by the Italian Municipality if spouse/part of an Italian civil union; in the case of a spouse/part of a civil union who is a citizen of another EU country, a multilingual international marriage/civil union certificate;
  • In the case of an emotional relationship other than marriage, a self-certification attesting to the type of relationship (Cohabitant self-certification );

VOLUNTARY REPATRIATION

  • Request for revocation of the ban on re-entry into Italy to be addressed to the competent Prefecture in Italy;
  • Birth certificate with Apostille, issued no earlier than three months from the submission of the application. N.B: In case of a change of personal data, it will also be necessary to present the “Certificate of Archive” with Apostille and its translation into Italian;
  • Passport and 2 photocopies of the pages containing personal data, as well as entry and exit stamps;
  • Only in the event of a lost passport or detention by the competent border authorities, appropriate documentation proving the exact date of exit from the national territory and the absence from the territory of the Schengen states for the duration foreseen by the expulsion decree;
  • Copy of the expulsion decree* (if lacking the decree, read the note at the bottom of the page).

*If you do not have the expulsion decree, it is necessary to obtain it before submitting the visa application by requesting access to the records.
The right to access and the related procedures can be exercised directly with the authority responsible for the national section of S.I.S. II, which in Italy is the Ministry of the Interior, Department of Public Security.
